TEXAS TAX-SALE PROCEEDS

Tax-sale proceeds
need their own review.

Texas tax-sale excess proceeds involve a specific court-record trail. Identify that process before applying a general foreclosure checklist.

What makes this a separate research path?

Begin with the judgment, cause number, sale information and any funds recorded with the court. A property address may lead to several records, so match the sale you are researching to the relevant case rather than assuming every document belongs to the same transaction.

Timing and fees are not one-size-fits-all

For claims governed by Texas Tax Code §34.04, the petition deadline is before the second anniversary of the sale. Section 34.04(i) also restricts fees: non-attorneys may not charge a fee to obtain covered excess proceeds for an owner. These rules should not be generalized to every mortgage foreclosure. Ask a licensed Texas attorney about the applicable claim, representation and any proposed arrangement. Caliber does not advertise a non-attorney recovery fee for this covered tax-sale process.

Questions to ask about the record

Why the original sale figure is not enough

A letter may highlight the winning bid. That number can establish a starting point for a calculation, but the result depends on deductions and the current record. Keep copies of the documents you actually used and note the date of the review.

If you have an older notice, do not simply reuse its figures in a new letter. Confirm whether the record has changed. Our case breakdowns are dated snapshots, so a newer estimate requires a new snapshot.
